Agreement - Register to be a PEC tutor

An agreement between you ("The Tutor") on the one part, and Potential Education Centre ("PEC") on the other part.

Whereas "The Tutor" wishes to tutor students referred by "PEC" and "PEC" maintains a current register of Tutors, and refers students requesting tutoring to "The Tutor".

The Tutor and PEC hereby agree that:

1.       The Tutor is self-employed, and is free to accept or reject students referred to him/her by PEC.

            The relationship between PEC and the Tutor is NOT one of employer and employee.

2.       PEC or his representatives shall not be under a liability whatsoever whether at common law or by stature, for acts or omissions of the Tutor.

            The Tutor hereby agrees to indemnity PEC from any claim arising from any injury, damage to the Tutor or to the Tutor's property, as a direct result of tutoring students referred by PEC, or malpractice on the part of the Tutor.

3.       The Tutor agrees to charge the family/student the appropriate rate as indicated on the PEC's current rate table, and as determined by PEC and to conduct tuition in the student's home, unless directed to do otherwise by PEC.

           The family/student will make the payments directly to the Tutor except the first hourly rate, as remuneration for the Tutor's professional services to the students.

4.       The Tutor agrees to issue the family/student a receipt upon payment by the family/student after each tutorial session.

5.       The Tutor agrees to pay PEC the referral fee indicated on PEC's current rate table for each student referred by PEC, and accepted for tutoring by the Tutor. The cost of the first lesson is paid to PEC, instead of Tutor, by the family/student referred as part of the referral fee that Tutor needs to pay PEC.

             The Tutor will make such payment within 30 days of accepting the referral.

             In the event that the student has less than the agreed minimum number of hours tuition as specified by PEC, PEC may reduce the referral fee charged to the Tutor. The amount of reduction to be at the discretion of PEC.

6.       The Tutor agrees to give oral or written acceptance or refusal to PEC with twenty four hours of notification of a student requiring tutoring.

         Upon accepting a student for tutoring the Tutor shall promptly contact the family/student THE SAME DAY as receiving the referral to make or confirm the arrangements for the first lesson.

        The Tutor agrees to immediately notify PEC:

·                                 If the first lesson does not go ahead within 30 days

·                                 When tuition is no longer required by the student

·                                 When/if tuition re-commences following a break in tuition

7.       The Tutor agrees to notify PEC when tutoring finishes, or when tutoring cannot continue for any reason.

              The Tutor agrees wherever possible to give PEC and the family/student fourteen (14) days notice of their inability to continue tutoring the student.

          The Tutor agrees to cease tutoring the student upon reasonable request to do so by PEC.

8.       The Tutor agrees to refer to PEC all enquiries for tutoring from any student/family who has received tutoring through PEC, or any person recommended by any past or present students or families referred by PEC.

9.       The Tutor agrees to be punctual for all tutorial sessions, to be acceptably presented (neat casual dress), and to conduct his/herself at all times in a professional manner, in accordance with PEC Tutors Code of Conduct.

10.    PEC retains the right to cancel this Agreement in the event that the Tutor fails to comply with a clause or clauses of this Agreement. Such termination shall not affect any liability on the part of the Tutor relating to events prior to termination.

11.    This agreement may be terminated by either party, by giving written notice of termination to the other party.

I have read the above clauses and agree to tutor students referred to myself by PEC, under these terms and conditions. I further agree that the information provided by myself on my resume sent to PEC is true and correct.
